Patrick to announce for senator on Laura Ingraham show tomorrow

This has been such a bizarre incident. Patrick and Dewhurst went at each other verbally, but in loud voices, in a Senate committee of the whole earlier today. One of the subjects was David Simpson’s anti-grouping bill, about which I wrote earlier. Patrick manipulated a situation in which he was able to accuse of Dewhurst of sinking his and Simpson’s anti-groping bill Tuesday night — and, further, of being “someone who will not stand up to the federal government.” I’m no admirer of Dewhurst’s leadership of the Senate this session, but Patrick, in one moment, reverted to the showboat side of himself that he has kept under wraps this session. This is theatre of the absurd. What is a responsible politician supposed to do when a U.S. Attorney says that a state legislative action is in violation of federal law and warns that the federal government will seek an emergency stay old the legislation? Perhaps Dewhurst could send Brandon Creighton to negotiate. I don’t think sending the federal government a copy of the Tenth Amendment is going to change the U.S. Attorney’s mind. This has to be one of the all-time clownish moments of the Texas Legislature.

Why is Patrick a show boat, but Senfronia Thompson is not? Porn on the House floor, really? Yeah the flyer was tacky, but why bring it up on the House floor? What about Trey Fischer (we all know he just recently adopted the “Martinez” for political reasons) reading names of lobbyists? What about Solomons reading the names of lobbyists and special interests?

All state senators must run in their new districts in 2012. Dan Patrick cannot run for both the U.S. Senate and the Texas Senate on the same day. (If Hutchison were to resign early, Governor Perry would have to call a special election for the U.S. Senate and Patrick could remain a member of the Texas Senate until his term expired on Dec. 31, 2012.

Don’t be so sure, Anonymous. In a primary that will be Tea Party crazy, Patrick could easily muscle out lightweight Ted Cruz and give Michael Williams fits by connecting with the voters who just can’t quite support people of color. If Patrick can raise millions of dollars for the effort, he’ll be a force. The Republicans will nominate a right winger, and that right winger will be the next U.S. Senator from Texas.

  16. Sen. Dan Patrick says:

    Paul,

This was a serious bill. The program we were trying to stop is NOT federal law, it is simply policy. Many legal experts did not believe our bill was unconstitutional. If so how did the bill pass both the House and Senate committee without any of the many legal experts we have in and around the Capitol stopping it. Where was the opposition from the DOJ or TSA before the 11th hour?

As far as Dewhurst’s involvement he called on me to bring the bill up. I did not know he had told some Senators he was not going to call the bill up. He then went down on the Senate floor and asked Sen Watson to go around and get votes to block while I was speaking. At the same time the letter was distributed. That is unacceptable.

He then said he had nothing to do with killing the bill and it was Sen Watson who killed it. However, Sen Watson has confirmed Dewhurst came to the floor and asked him to block the bill. Other Senators are aware as well even if they are not talking publicly. We also now know, the Lt Governor’s office confirmed to me. that they asked for the letter. I had the votes at 10 am that morning and he asks for a letter that was clearly intended to kill the bill in my view. I asked to call on me that morning and he said a letter was coming and he wanted to wait for it. I told him then why would we wait. They weren’t going to send us a letter praising the bill.

You may think it’s not a big deal, but a lot of Texans think it’s a big deal when the federal government threatens a state over proposed legislation. It is our right to pass legislation.

I didn’t start the fight over the bill. Dewhurst did. He could have simply not called on me. He could have called on me and made a public statement that he opposed the bill. But he should not have called upon me, then worked the floor against it, and then covered up the fact by blaming another Senator.

If you think standing up against the federal government, or having the courage to take on the Lt Gov is a light moment, I would respectfully disagree.

One thing you were right on, I did announce my exploratory committee on Laura’s show this morning. That decision was made prior to, and arranged, before the TSA issue this week. I had 30 votes on that bill and little opposition. I expected to pass the bill easily without interference from the Lt Gov. It was not part of the plan concerning my announcement today.

Like them or not, we can’t choose to not follow them, unless we are prepared to start our own Texas Aviation Association and govern our own airlines, airports, etc. I don’t think you want that. A fleet of crop dusters and Cessna’s is not good for International travel. It was a bad bill, and a publicity stunt, Senator, and you know it had no chance of every passing muster. Look, you can talk all you want on the merits about how far TSA agents should be allowed to go in searching people (I certainly think some of those agents go too far), but this is about as clear a case of pre-emption as I’ve ever seen.

The 10th Amendment reserves to the states powers not reserved to the federal government. BUT…the Constitution reserves to the federal government the power to regulate interstate commerce. It’s obviously a long standing debate between conservatives and liberals as what constitutes regulating interstate commerce, but seriously, how much more commercial and interstate can you get than ensuring the safety of commercial airplane flights?

Since the feds have the power to regulate airplane safety, and they did regulate airplane safety, and since the supremacy clause means federal law pre-empts state law, the state law would be pre-empted.

(I do agree that the Democrats shouldn’t have voted for this bill, but that’s no shield for saying it’s a dumb bill).
