Holding to their values shouldn’t land legislators on either list. Working to find solutions and forging compromises without giving up those values should put one on the best list; likewise, abandoning values for expediency or consistently mucking up compromises should land one on the worst list.
I also think you need to add a new category; a category reserved for anyone who runs to the mike as soon as Burka walks on the floor.

Dear Texas Monthly, WHY are the republicans voted as the best legislators? They have KILLED our public education system. It was already crippled. You will all see, all colleges and businesses will all see, in the next ten years how the quality of public education will be watered down. These wonderful legislators don’t even send their kids to public school. They attend private school. Steve Ogden wants the state to pay for textbooks for PRIVATE schools. This is crazy! He will not fight for public education, but he sure will fight for private. It doesn’t sound like to me that he represents the common Texas citizen well at all! And Rick Perry is the worst excuse for a governor Texas has ever seen! He’s only out for his political gain and keeping oilmen and businesses "happy". He tries to act like he’s JR EWing. I don’t know... maybe he’s a relative.
