Liberty Counsel, a Florida organization “dedicated to advancing religious freedom, the sanctity of life, and the family,” has filed a complaint with the Equal Employment Opportunity Commission against Macy’s on behalf of Natalie Johnson, a former employee of the company’s San Antonio Rivercenter store who claims she was fired for refusing to let a transgender customer have access to the women’s changing room.

According to Liberty Counsel’s press release, “Johnson’s boss referred her to Macy’s LGBT policy which allows ‘transgender’ people to change in any dressing room they want. However, Johnson pointed out that the same policy also protects against religious discrimination and, in this case, it protects her right to her beliefs that were being violated.”

But Jay Morris of counters, saying, “The claims by Liberty Counsel are not a declaration of freedom, but instead further desperate attacks by a group of people protected by Federal Non-Discrimination Laws (religious people), on a group that is not (transgender people).”

Macy’s official statement to various media outlets, including to the San Antonio Current on Twitter, was “we recognize and appreciate the diversity of our customers and associates.”

Liberty Counsel founder and chairman Matt Staver told Abe Levy of the San Antonio Express-News , “This policy is fraught with problems because it opens up the fitting room for anyone to come in, and employees are not permitted to question it. To me, it’s a liability waiting to happen. It’s just a matter of time that a man goes into a female fitting room and watches women undress or, even worse, rapes a woman.”

To which Bridgette P. LaVictoire of the blog Lez Get Real responds, well . . . get real.

Despite claims that trans women are still men, most transphobes ignore the fact that the majority of trans women are attracted to men. They also ignore how insanely difficult it is to peek over a stall door or sneak a peek at a woman in a dressing room. So far, there have been no reported cases of anyone who is transsexual, transgender or claiming to be one of those actually spying on women in those places. Really, that scenario exists only in the minds of those who are trying to justify their beliefs.
